Under the Points Based System UK employers have to be licensed by UK Visa and Immigration (UKVI) before they can employ non-EEA workers. This includes unpaid work, e.g. if you run a charity. Therefore having a sponsor licence is very important.

Employers who do not have a sponsorship licence will be unable to hire new workers from outside the EU or extend work permits for current employees.

Employers can get a fine (also known as a civil penalty) of up to £20,000 per person for employing illegal workers.

What do employers have to do?

The employers have to be licensed by UK Visa and Immigration (UKVI) before they can employ non-EEA workers.

To make a sponsor licence application employers must establish that:

  • They are a genuine organisation operating lawfully in the UK.
  • Their key personnel named on the sponsor application are honest, dependable and reliable
  • They are aware of and capable of carrying out their visa sponsorship duties ie they have appropriate human resources and recruitment systems and practices in place
  • They are offering genuine employment that meets the Tier 2 (General) skill level and appropriate rates of pay

Eligibility

To get a sponsor licence, the employers can’t have:

  • unspent criminal convictions for immigration offences or certain other crimes, eg fraud or money laundering
  • any history of failing to carry out your sponsorship duties
  • youll need appropriate systems in place to monitor sponsored employees
  • UK Visas and Immigration (UKVI) will review your application form and supporting documents. They may visit your business to make sure you’re trustworthy and capable of carrying out your duties.

Apply for Sponsor Licence

  • Employer must complete an online licence application and provide supporting documentation to meet the necessary evidentiary requirements.
  • Evidence must be supplied within five days of the initial application.
  • Following the receipt of these documents, the employer may then be subject to a compliance visit from UK Visas and Immigration, who will assess whether or not to grant the licence.
  • Employer will also be required to comply with the illegal working requirements.
